Terms of Service

(2) These Terms apply to all offers, services, and contracts relating to use of the Tamaem platform, including free and paid features.

(3) Tamaem is offered to consumers and business users unless a feature is explicitly marked otherwise. If mandatory consumer protection laws in your country give you rights that cannot be waived, those rights remain unaffected.

(4) By registering or completing a purchase, you confirm that you have read these Terms and accept them.

(1) Use of paid features requires a registered account. During registration you must provide accurate, current, and complete information and keep your login credentials confidential.

(2) You may register with email and password or sign in with Google via our authentication provider. You are responsible for all activity under your account.

(3) Paid features require you to be at least 18 years old, or the age of majority in your jurisdiction.

(4) A contract for a subscription or credit purchase is formed when you complete checkout and payment is successfully processed by Creem, our Merchant of Record.

(5) You may browse pricing before creating an account. Plan selection during registration or on the Pricing page is binding at checkout.

(1) Platform services: Tamaem provides cloud-based tools to generate and manage AI music, images, and video, including related features such as lyrics assistance, stem separation, downloads, history, and gift sharing as described on the website.

(2) Credit system: Paid features consume credits. Credit costs per action are shown in the app and on the Pricing page. Credits are digital units delivered to your wallet after successful payment.

(3) Plans: We offer monthly subscriptions, annual subscriptions, and one-time credit top-ups. Current tiers include Starter, Plus, and Pro with the credit allocations and prices shown on the Pricing page at the time of purchase. Top-up packs require an active paid subscription unless stated otherwise on the Pricing page.

(4) No success guarantee: We provide the technical platform only. We do not guarantee specific creative results, commercial success, uniqueness of outputs, or uninterrupted availability of third-party AI models.

(5) Platform changes: We may develop, modify, or discontinue features if the core service is not materially impaired. There is no entitlement to any specific model, integration, or feature forever.

(6) Plan changes: Upgrades or downgrades while a subscription is active take effect at the start of the next billing period unless checkout or the app states otherwise. Credits already allocated for the current period are not retroactively adjusted except where required by law.

(1) Prices are displayed on the Pricing page and at checkout in US dollars unless another currency is shown. Applicable taxes and invoicing are handled by Creem as Merchant of Record.

(2) Subscriptions renew automatically for the selected billing interval (monthly or annual) until cancelled through Creem or as described in your account settings.

(3) Payment processing: Creem collects payment on our behalf. You authorize Creem to charge your selected payment method for subscriptions, renewals, and top-ups. We do not store full card numbers on Tamaem servers.

(4) Credits and digital delivery: Credits are delivered immediately after successful payment. Used credits are not refundable except as stated in our Refund Policy.

(5) Price changes: We may change prices, credit allocations, or plan features for the future. Price increases for existing subscriptions will be communicated in advance where required by law; you may cancel before the change takes effect.

(6) Payment failure: If payment fails, we may suspend paid features until the balance is settled. Statutory rights regarding consumers remain unaffected.

(7) Invoices and receipts are provided electronically through Creem.

You agree to:

• Use Tamaem lawfully and only for its intended creative purposes
• Provide truthful registration data and keep your account secure
• Ensure you have the rights to any lyrics, prompts, uploads, or other inputs you submit
• Review AI outputs before publishing or commercial use

You must not:

• Generate or distribute illegal, hateful, harassing, or defamatory content
• Create or request pornographic, sexually explicit, or other adult (NSFW) images or video
• Infringe copyright, trademark, privacy, publicity, or other third-party rights
• Impersonate artists, celebrities, or other persons without authorization
• Reverse engineer, scrape, probe, or bypass rate limits or security controls
• Share account access, resell the platform, or use outputs primarily to replicate the service itself

You are solely responsible for inputs you provide and how you use generated outputs. We do not routinely monitor all user content but may remove content or suspend accounts that violate these Terms or law.

You indemnify us against third-party claims arising from your unlawful use of Tamaem or infringement of third-party rights, except where caused by our intentional misconduct or gross negligence.

(1) Your inputs: You retain ownership of content you submit. You grant us a limited license to host, process, and transmit it solely to operate Tamaem and enforce these Terms.

(2) Generated outputs: Subject to these Terms and applicable law, you may use outputs for personal or commercial projects, except where restricted by our AI providers' policies or third-party rights.

(3) Our platform: The Tamaem brand, software, and documentation remain our property or that of our licensors. These Terms do not grant rights in our underlying technology.

(4) No warranty of uniqueness: AI outputs may resemble other works. We do not warrant that outputs are error-free or free from third-party claims.

(1) Support: Contact us at support@tamaem.com for account, billing, or technical questions. We aim to respond within 2 business days.

(2) Availability: We strive for high availability but do not guarantee uninterrupted operation. Maintenance, updates, or failures of hosting or AI providers may cause temporary downtime.

(3) Third-party dependency: Tamaem relies on external providers (including Supabase, Creem, and AI generation partners). Outages outside our reasonable control do not entitle you to compensation beyond our Refund Policy.

(4) Technical requirements: You are responsible for a compatible device, browser, and internet connection.

(1) The service is provided "as is" and "as available" to the maximum extent permitted by law.

(2) We are liable without limitation for intent, gross negligence, and injury to life, body, or health.

(3) For simple negligence breach of essential contractual duties, liability is limited to foreseeable typical damage.

(4) Otherwise, our total liability for any claim relating to Tamaem is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim.

(5) We are not liable for indirect damages, lost profits, or loss of data except where mandatory law provides otherwise.

(6) These limits also apply in favor of our representatives and vicarious agents where permitted by law.

(1) You may stop using Tamaem at any time. Cancel subscriptions before the renewal date to avoid future charges.

(2) Cancellation takes effect at the end of the current paid billing period unless mandatory law requires otherwise. Access to subscription credits may end when the period expires.

(3) We may suspend or terminate accounts that violate these Terms, pose security or legal risk, or remain in payment default after notice.

(4) Upon termination, your right to use the platform ends. Export any content you wish to keep before closing your account. We may delete account data after a reasonable period, subject to legal retention duties.

(5) Unused credits are handled according to our Refund Policy. Statutory withdrawal rights for consumers remain unaffected where applicable.

We process personal data as described in our Privacy Policy. If you process personal data of third parties through Tamaem, you are responsible for having a lawful basis to do so.

We may update these Terms when our services or legal requirements change. Material changes will be posted on this page with an updated date. Continued use after the effective date constitutes acceptance unless mandatory law requires separate consent.

(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protections in your country of residence remain unaffected where applicable.

(2) If you are a merchant, public-law entity, or public-law special fund, exclusive place of jurisdiction is the courts at the Provider's registered seat in Germany, where permitted by law.
